This Acceptable Use Policy ("AUP") governs the use of websites, applications, business operations tools, and any other digital assets built, hosted, or managed by Evolvyx LLC ("Company") on behalf of its Customers. This AUP is incorporated into the Terms of Service and any applicable Master Services Agreement. By using the Services, you agree to comply with this AUP. Violation of this policy may result in suspension or termination of Services.
1. Permitted Use
The Services are provided for lawful business purposes. You may use the websites, applications, and tools built and managed by the Company to conduct your legitimate business operations, including but not limited to:
- Operating a business website, portfolio, or landing page
- Running an e-commerce store to sell legal products and services
- Managing business operations (timesheets, purchase orders, scheduling, workflows)
- Communicating with your customers, employees, and partners
- Collecting and processing data necessary for your business, in compliance with applicable laws
- Storing and managing business documents and records
2. Prohibited Content
You may not use the Services to host, distribute, or link to content that:
- Is illegal under applicable federal, state, or local law
- Infringes on any third party's intellectual property rights, including copyright, trademark, patent, or trade secret
- Contains malware, viruses, ransomware, spyware, or any other malicious software
- Promotes violence, terrorism, or hatred against any individual or group based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristic
- Contains or distributes child sexual abuse material (CSAM) or exploits minors in any way
- Is defamatory, libelous, or constitutes harassment or cyberbullying
- Is deceptive, fraudulent, or designed to mislead consumers (including phishing schemes, fake reviews, or misleading product claims)
- Contains pornographic or sexually explicit material (unless explicitly agreed upon for adult-oriented businesses operating in compliance with all applicable laws)
- Violates any individual's right to privacy, including publishing personal information without consent
3. Prohibited Activities
You may not use the Services to:
- Send unsolicited bulk email (spam), including via forms, integrations, or automated systems connected to your site
- Conduct or facilitate phishing, social engineering, or credential harvesting
- Attempt to gain unauthorized access to the Company's systems, other customers' accounts, or any third-party systems
- Mine cryptocurrency or run computationally intensive workloads on infrastructure managed by the Company
- Scrape, crawl, or harvest data from other websites or services in violation of those services' terms
- Resell, sublicense, or redistribute the Services to third parties without the Company's written consent
- Bypass, disable, or interfere with any security features, access controls, or usage limits
- Use automated tools to overload or stress-test the infrastructure without prior written approval
- Store sensitive data (payment card numbers, Social Security numbers, health records) on the Company's systems unless the engagement specifically includes compliant infrastructure for such data
4. E-Commerce Specific Requirements
If the Company builds or manages an e-commerce store for you, you are responsible for:
- Ensuring all products and services sold are legal in the jurisdictions where you operate and sell
- Complying with consumer protection laws, including clear pricing, honest product descriptions, and fair refund policies
- Complying with payment card industry (PCI) standards where applicable (note: the Company uses Stripe for payment processing, which handles PCI compliance for card data)
- Collecting and remitting applicable sales taxes
- Honoring your published return and refund policies
- Maintaining proper business licenses and permits for the products or services you sell
5. Business Operations Tools
If the Company builds custom business operations tools for you (under the Scale tier), the following additional requirements apply:
- You are responsible for the accuracy and legality of data entered into the system by you and your employees
- You must comply with employment laws and labor regulations when using timesheet and scheduling features
- You must not use the tools to evade tax obligations, falsify records, or commit fraud
- You are responsible for managing user access within your Organization and ensuring that only authorized personnel can access sensitive operational data
- The Company is not responsible for business decisions made based on data or reports generated by the tools
6. Resource Usage
The Company provides shared hosting infrastructure through Vercel and Supabase. To ensure fair usage for all Customers:
- Storage is subject to reasonable limits based on your subscription tier
- Bandwidth spikes from viral content or DDoS attacks may result in temporary throttling
- Database usage should be consistent with normal business operations. Bulk data imports or migrations should be coordinated with the Company in advance
- If your usage significantly exceeds normal patterns for your tier, the Company may recommend an upgrade or impose fair-use limits after providing notice
7. Security Responsibilities
While the Company implements security measures as described in the Service Level Agreement and Data Processing Addendum, you are responsible for:
- Keeping your account credentials secure and not sharing login details
- Using strong, unique passwords for your portal account
- Promptly notifying the Company if you suspect unauthorized access to your account
- Managing Organization member access and promptly removing members who should no longer have access
- Not disabling or circumventing security features implemented by the Company
8. Enforcement
8.1 Reporting Violations
If you become aware of a violation of this AUP, please report it to legal@evolvyx.io. The Company investigates all reports and takes action as appropriate.
8.2 Company Response
Upon identifying a violation, the Company may take one or more of the following actions at its discretion:
- Issue a written warning with a deadline to cure the violation
- Remove or disable access to the offending content
- Temporarily suspend the affected Services pending investigation
- Permanently terminate the Customer's account and Services
- Report the activity to appropriate law enforcement authorities
8.3 Notice and Cure
For non-critical violations, the Company will provide written notice and a reasonable period (typically 5 business days) to cure the violation before taking enforcement action. For critical violations (illegal activity, security threats, CSAM), the Company may take immediate action without prior notice.
9. Third-Party Content and Integrations
The Services may integrate with third-party tools, APIs, or platforms (payment processors, email services, analytics tools, etc.). You are responsible for complying with the terms of service and acceptable use policies of those third-party services. The Company is not responsible for third-party service availability, data practices, or content.
10. Modifications
The Company may update this AUP from time to time. Material changes will be communicated via email or portal notification at least thirty (30) days before they take effect. Continued use of the Services after changes take effect constitutes acceptance of the revised AUP.
